NAACP seeks records in Pasadena police shooting

PASADENA - Local NAACP officials Thursday called on the Police Department to release crucial documents and video surrounding the death of a local man shot by officers during an altercation last week.

The letter sent to the department and news outlets came as police refused to comment further on the events of Feb. 19, when Leroy Barnes, 38, was shot to death by police during a traffic stop.

Police also placed a security hold on the autopsy results, preventing any information about how many times Barnes was shot and the location of his bullet wounds from being disclosed, Los Angeles County Department of Coroner spokesman Ed Winter said Thursday.

Pasadena police spokeswoman Janet Pope Givens said the department would treat the NAACP's request for information like any other public information request, meaning the department will decide within 10 days whether or not to honor the request.

She also declined to answer for the Pasadena Star-News whether the two officers who shot Barnes were involved in either of two previous police shootings this year.

"We are not talking any more about the case, we are not talking any more about the officers," Pope Givens said in a voicemail message Wednesday night. "At this particular point we're not looking at making any more statements for the next 30 days or so."

The decision not to make further comments about the case was "made out of respect to the family" of Barnes, whom Police Chief Bernard Melekian met with Wednesday, Pope Givens said.

Barnes and a friend, Ameka Edwards, who was driving, were pulled over by police at about 4:20 p.m. Feb. 19 at Mentone Avenue and Washington Boulevard. Moments later, reports of shots fired came over police scanners.

A few hours later, Pope Givens told reporters Barnes got out of the car and fired a gun at officers, who returned fire, killing him.

The next day, however, Melekian said Barnes was shot in the back seat of the car.

On Tuesday, Melekian said Barnes never fired a gun and was in fact shot during a struggle with an officer in the back seat of the vehicle. Officers fired 11 rounds at Barnes, the chief said.

NAACP Pasadena Chapter President Joe Brown said his organization requested information pertaining to the shooting after receiving multiple requests from residents.

His letter asks that the department release dispatch records, written and taped reports, coroner's reports, recorded interviews regarding the shooting and copies of several department policies and procedures.

A dearth of information has raised numerous questions about the shooting, Brown said in his letter.

"At this point we have nothing," he said in an interview.

The NAACP chapter has retained two seasoned criminal attorneys, who volunteered to assist in the matter, he said.

"We have two first-class attorneys who will be looking at documents on behalf of the NAACP regarding this case as soon as we are able to receive them," he said.

While the NAACP, ACLU and media organizations press for more information, local community activists have helped keep residents informed of what is happening, Brown said.

"I support the other activists in this community who are keeping peace and keeping calm in this town," he said. "I hope they would continue to do just that and know that justice is going to prevail."

Despite recent community anger over the city's break down of a memorial to Barnes, and the sudden cancellation of the annual Black History festival on Feb. 21, the community is handling things in an organized way, Brown said.

"Most people in this community are peaceful," said local activist Tarik Ross. "Of course, a lot of people want answers. But at the same time, nobody is going to burn police cars or riot at the Black History Festival."

Local youth advocate Jon Brookhart agreed.

"We're equating this to a problem of, `how did this happen,' `why did it happen' and `should it have happened'," Brookhart said. "(Authorities are) asserting that we're going to do the wrong thing because they did the wrong thing."

During the public comment period at the regular meeting of the Northwest Commission, residents continued to speak out about the shooting.

Clarence Nelson, 37, called for Melekian's resignation, saying his reaction to the shooting has been "nonchalant."

"My brothers are dying on the street and we're being treated with injustice," he said.

He also called for an independent investigation of the shooting, a request echoed by Michelle White, president of the ACLU's Pasadena chapter.

"We think that it's a conflict of interest for the police department to investigate itself," she said. "We need to have some kind of closure on this and I don't think police can do this for us."

message: City officials have not been forthcoming and have shown abject disrespect for Northwest citizens in this case. Their story changes by the minute! We have yet to see the tape! I've read that they have refused FBI inquiry! What have they to hide?The PPD is also under fire for the killing of a female passanger by a officer firing indiscreminately into a passing car! In my view the situtation is out of control! There have been several other killings like that of Mr. Barnes in recent years in this city that is becoming more like Gaza-dena!

Hold the New York Post accountable

The New York Post recently published the political cartoon shown here, depicting two white police officers standing over the carcass of a bullet-riddled chimpanzee, with the animal representing the author of the stimulus package.

The decision to run this cartoon was irresponsible at best, and hurtful and malicious at worst. It seems unthinkable that an editor of a newspaper would not understand the history of Black folks being depicted as monkeys and apes or the recent spate of death threats against President Obama. Worse, when confronted, Post editor Col Allan dismissed people's concerns as baseless.

Join us in demanding that The Post issue an apology for the decision and their callousness, and fire the editor who allowed this cartoon to go to print.

Judge clears dead Texas man of rape conviction February 07, 2009 2:59 AM EST
AUSTIN, Texas - A man who died in prison while serving time for a rape he didn't commit was cleared Friday by a judge who called the state's first posthumous DNA exoneration "the saddest case" he'd ever seen.

State District Judge Charles Baird ordered Timothy Cole's record expunged.

Cole was convicted of raping a Texas Tech University student in Lubbock in 1985 and was sentenced to 25 years in prison. He died in 1999 at age 39 from asthma complications.

DNA tests in 2008 connected the crime to Jerry Wayne Johnson, who is serving life in prison for separate rapes. Johnson testified in court Friday that he was the rapist in Cole's case and asked the victim and Cole's family to forgive him.

"I'm responsible for all this. I'm truly sorry for my pathetic behavior and selfishness. I hope and pray you will forgive me," Johnson said.

The Innocence Project of Texas said Cole's case was the first posthumous DNA exoneration in state history.

"I have his name," Cole's mother, Ruby Cole Session, said after the hearing. "That's what I wanted."

Cole and his relatives for years claimed he was innocent, but no one believed them until evidence from the original rape kit was tested for DNA. Cole had refused to plead guilty before trial in exchange for probation, and while in prison, he refused to admit to the crime when it could have earned him release on parole.

Africans purchase 36 billion bottles of Coke a year, at a price of 20-30 American cents per bottle. Since the price is so low, and because Coca-Cola analyzes sales so closely, the Coke bottle has actually become a reliable tracker of stability and prosperity in Africa.


For example, the ups and downs during Kenya’s post-election violence this year could be traced in sales of Coke in Nairobi’s slums and in western Kenya’s villages.

Coca-Cola is the largest private-sector employer in Africa. A study has suggested that 1 percent of South Africa’s economy is in some way related to the distribution and sale of Coke.

The company expects sales in Africa to grow by an annual 10 to 13 percent over the next few years, outstripping economic growth.

CHICAGO (AP) — Gov. Rod Blagojevich on Wednesday talked about sending state troopers or even the Illinois National Guard to help Chicago combat crime — an offer that Mayor Richard Daley didn't know was coming.

Appearing at a signing ceremony for a bill that toughens the penalty for adults who provide guns to minors, Blagojevich said "violent crime in the city of Chicago is out of control."

"I'm offering resources of the state to the city to work in a constructive way with Mayor Daley to do everything we can possibly do to help" stop this violence, the governor said.

Blagojevich said Daley had not asked for help and that he would call Daley later in the day.

Daley's spokeswoman Jody Kawada said the mayor welcomed a partnership on any issue but declined to comment until they knew more about what Blagojevich planned.

City police spokeswoman Monique Bond also said it was too soon to comment on the offer.

But she also took issue with the governor's contention that crime is "out of control" in Chicago. In fact, she said if the current murder rate holds, 2008 would be one of the least deadly years in the city in the last 40 years.

Violent crime has spiked in Chicago recently, however. Nine people were killed in 36 shootings during one weekend this spring and Chicago Public Schools officials say more than two dozen students have been killed by gunfire since last September.

Blagojevich had few details on his offer. Possibilities he mentioned were having state troopers work in lower-crime areas, freeing Chicago police officers for areas with more crime, or making temporary hires of retired city police and state troopers.

Blagojevich said it is far more likely that state troopers would be used than guardsmen. In fact, his office moved quickly after the governor's comments to stress in a news release that Blagojevich was not considering bringing in National Guard troops to the city.

"The only way the National Guard would be involved, if they are involved, is with the use of tactical helicopters that are currently used in narcotics operations," spokesman Lucio Guerrero said in a statement.

Re: Media Message "connect the dots, and get the picture!"

Your are right my Brother, this is just more of the same! If you line all of the media generated hate-talk and connect the dots a clear picture forms -- in my view it a very ugly picture that has a very long history (over 400 years long).
I'd say the KKK has taken off their hoods and replaced them with business suits and blue uniforms.

There is a rhetorical question going around the white-supremist websites
that asks: "If Obama wins can the seat of power still be called 'the whitehouse?'" Good question!
